Getting Trade Mark

Trade Mark word, logo, signature or Invented word that you are willing to use for your business and if you want a legal right over the word, logo, signature so no other entity use it to represent its business then you need to register your mark under the Trade mark Act, 1999.

Why Trade Mark

Trademark registration allows you to prevent others from using or registering a similar mark. As a registered national trademark holder, you would have nationwide priority when any conflicts arise. Trademarks are "intangible" assets that increase your company's value. If you ever sell your business or take it public, this will surely increase your company's value.

Trade mark Can be:

•  Names, including your own name or surname

•  An invented word or any arbitrary dictionary word or words. It does not need to be descriptive of the        character or quality of the goods/service

•  Letters or numerals or any combination

•  Symbols

•  Monograms

•  Combination of colours or even a single colour in combination with a word or device

•  Shape of goods or their packaging

•  Marks constituting a 3-dimensional sign.

•  Sound marks when represented in conventional notation or described in words by being graphically    represented

Time Period Involved In getting Trademark is 24 Months Approx

TM' Symbol: Generally, one who has filed an application (pending registration) can use the TM (Trademark) symbol with the mark to inform the public of his exclusive claim over the Brand. The claim may or may not be valid.

R' Symbol: The registration symbol ® may only be used when the mark is registered and the Certificate of Registration is issued by the Trademark Registrar.
